FAQs: Commercial Asbestos Duties
The laws regarding asbestos in commercial buildings are strict. Here are the answers to the most common questions from duty holders and facility managers.
The "Duty Holder" is usually the building owner, the landlord, or the person/organization responsible for the maintenance and repair of the non-domestic premises. If you have a tenancy agreement that says you are responsible for maintenance, the duty is yours.
Any non-domestic building built before the year 2000 requires an asbestos survey. This includes offices, shops, factories, schools, hospitals, and common areas of residential blocks (like foyers and stairwells)
Failure to comply with Regulation 4 is a criminal offense. You can face unlimited fines, prosecution by the HSE, and your building could be closed down until it is made safe.
If asbestos is found and left in place (managed), it must be re-inspected regularly to check for deterioration. The standard recommendation is every 12 months, or sooner if the area is high-traffic.
